In an ordered date July twenty four,  2020

 the trial court overruled our objection and will allow a witness from abroad to testify. We respectfully disagree with this ruling and we intend to assail it before the court of appeals.
Nevertheless we are ready and prepared to cross examine the first witness when trial resumes next Tuesday. That witness will definitely confront a fierce and harsh cross examination from us - as we will hammer her on every contradictory and inconsistent statement that she made.
While the trial is ongoing, we will continue to question the ruling of the trial court to allow a witness abroad to testify via a petition for certiorari under rule 65. This issue is too precious for us to let go. And we need to have this issue resolved for our client as an insurance in the event of a protracted trial.
Meanwhile, we will cross examine each and every witness who will testify. Let’s see if the prosecution has other witnesses. Should the Prosecution fail to present other witnesses, it will not be able to prevent Francis from posting bail. The most critical element of the non bailable offense that we are facing requires more than one witness to testify.
It is easy to accuse but it is difficult to adduce evidence to prove it.
The fight goes on.
Let’s pray for Francis.
